SUBMERGED AQUATIC VEGETATION PLAYS A KEY ROLE IN THE LIMITS OF DOCKING FACILITIES

To those of you who are interested in extending a dock or placing a new dock in coastal waters under the general permitting process in Connecticut, you need to know that submerged aquatic vegetation plays a key role in the limits of docking facilities. Submerged aquatic vegetation typically becomes visible when it first emerges early in the summer. Generally, the beginning of June or so.

Submerged aquatic vegetation also defoliates in the fall, typically around the end of September.

If there is any dock project being planned, it would be advisable, in fact imperative, to get your project underway in the immediate future. If the submerged aquatic vegetation defoliates or begins the defoliation process before your submerged aquatic vegetation survey is complete, the lack of credible evidence relating to submerged aquatic vegetation may preclude you from making an application until June or July of the following year.

Barb and I went through almost 6 hours of deposition. My head is still pounding. I will NEVER understand what we are disputing can consume 36 hours of peoples’ lives without moving the world to a better place.

But I did describe your work (which arrived right on time). Their counsel is not inclined mathematically or with an inclining toward engineering. We are going to have to simplicity the math. But the point you made with me last night was made with them. They got the point that there is no impedance.

We’ve been remiss in not thanking you earlier for all your help in designing and building our beautiful dock. We would not have been able to do it without you.

We knew it would be a difficult process. In addition to the normal permitting barriers, we had to contend with extra outside attention and opposition. Not only did you handle the situation with grace and dignity, but you diffused many issues with knowledge. Who else knows not only the ins and outs of permitting and engineering, but also the players and personalities, who built which dock and when, the historical changing geography and riparian lines of the area, property rights and mean water marks, historical uses of waterways and what really is located under the harbor, etc. The breadth of knowledge is incredible.

Your advice on design and materials was spot-on. We didn’t have to worry about a thing, because you were there to make sure everything was done correctly. Our dock is beautiful and tasteful, and fitting for the area. The contractors were skilled artisans and the workmanship is exceptional. We have received many compliments on the dock, some from passing boaters. More importantly, we love it and will enjoy it for many years to come.

Again, we couldn’t have done it without you. I don’t know where else we could have found that unique combination of expertise that made it all possible. Thanks to you, your firm, and all your colleagues for such a fine job.

I was doing the planning to get the family together for “dock day” next month to get the dock in at 104 Latimer Point. I thought about how difficult the permit process is and how we never would have been successful without the help of Docko (Keith, Bill, and Joan). Being able to re-use the same dock that we were forced to remove by the DEP is especially pleasing, as it was designed to overcome some of the natural obstacles (rocks, low water) and still be constructed so that we can remove it for the winter. Giant’s Neck Beach in Niantic Connecticut has, like so many beaches along the Connecticut shoreline, suffered from a slow erosion due to varying effects ranging from a slow but constant littoral drift, storm patterns, and the steadily rising of the level of the sea due to global warming, whether caused by man or the natural cycles of nature or by a combination of both.

The sand on the beach at Giant’s Neck has tended to shift westward along its length only to ten be washed seaward by a stream which enters the Long Island Sound forming a sand bar at its west end.  Many possible solutions for restoration of our beach were discussed with several resources.  The Giant’s Neck Beach Association finally decided to contract with Docko, Incorporated of Mystic CT., experts in all aspects of recreational and commercial marine design and construction, to help us with our problem. Their solution for our specific erosion issue was to harvest sand from this offshore sand deposit and redistribute it along the entire length of the beach. 

The bottom line is that with Docko leading the way with mapping and engineering insight as well as administrative expertise in dealing with the DEEP, The state department of Fisheries and other government bodies, we were able to secure the required permitting and have begun our projected 5 year plan for beach restoration.  Keith Neilson, president of Docko, and his entire staff have helped make a process, which also included review of bids and oversight of the sand harvesting, efficient and painless.  We are very pleased with their efforts and the preliminary results.
